TERMS AND CONDITIONS

Terms and Conditions of Use and Sale

Conditions for using the website and purchasing and using PAYDAY EA licences.

Last updated: 18 October 2026

1. Scope and Acceptance

These Terms govern access to and use of the PAYDAY EA website and, where the identified operator is the contractual seller, the supply and use of PAYDAY EA software licences.

Visiting the website does not, by itself, constitute a purchase agreement.

Product purchases are subject to the contractual conditions presented to customers before they complete their orders.

Whop's applicable platform terms may also apply, without prejudice to mandatory consumer rights.

2. Product Description

PAYDAY EA is an Expert Advisor designed for use with the MetaTrader 5 (MT5) platform.

The software is designed to execute automated trading operations according to programmed parameters and rules, including risk management features.

PAYDAY EA does not constitute a portfolio management service, a custodial service or an investment guarantee.

Use of the software depends on technical and operational conditions, including compatibility with the user's MT5 environment and broker.

3. Products and Pricing

3.1. Initial Licence

The "PayDay EA - Licence" product is currently advertised at a reference price of €350, which includes the initial licence and the first 30 days of access.

3.2. Monthly Access

After the initial period, continued use of the software requires valid access.

The "PayDay EA - Monthly Access" product is currently advertised at €50 per 30-day period, with automatic renewal until cancellation, according to the conditions disclosed before purchase.

Renewal page:

https://whop.com/paydayea/payday-ea-acesso-mensal/

This option is intended for customers who have already purchased the initial licence.

3.3. Taxes and Charges

Before completing a purchase, customers should review the final price, applicable taxes, billing frequency and any additional charges displayed at checkout.

Any discrepancy between promotional information and checkout conditions should be clarified before the contract is concluded.

4. Orders and Payments

Purchases and commercial subscription management are handled through Whop.

Available payment methods, order confirmation and invoicing procedures depend on the applicable contractual arrangements and services.

Customers are responsible for reviewing the details displayed before confirming payment.

Seller identification, invoicing and contractual responsibilities must comply with applicable law.

5. Software Licensing

Purchasing a licence grants the customer a limited right to use the software under the agreed conditions, without transferring intellectual property ownership.

Unless expressly authorised otherwise, each licence is personal and restricted to one authorised MT5 trading account.

Unauthorised sharing, resale, redistribution or sublicensing is prohibited, without prejudice to rights granted by mandatory law.

Unauthorised use of third-party credentials or licence activation mechanisms is also prohibited.

Nothing in these Terms restricts statutory rights that cannot lawfully be excluded.

6. Activation and Technical Requirements

Software access depends on purchase confirmation and the applicable activation procedures communicated to the customer.

Requirements may include:

  • A compatible installation of MetaTrader 5.
  • An authorised MT5 account.
  • A compatible broker and financial instruments.
  • Reliable Internet connectivity.
  • Correct configuration of software parameters.
  • A valid licence and active subscription.

Customers are responsible for choosing their broker, managing their trading accounts and assessing the financial risks involved.

Specific features, requirements and limitations must be disclosed in the product documentation supplied to customers.

7. Renewals, Cancellations and Suspension

Monthly access is billed automatically for each 30-day period until cancellation.

Customers may cancel future renewals using the subscription management tools provided by the relevant platform, subject to applicable legal rights.

Cancellation prevents future renewal charges but does not automatically entitle customers to reimbursement for billing periods already started, without prejudice to statutory consumer rights.

Failure to pay or termination of a subscription may result in suspension of software access after the paid period.

According to the currently published commercial conditions, an existing initial licence that remains valid may be reactivated by purchasing a new access period without paying the initial licence fee again.

8. Statutory Withdrawal Rights and Refunds

Consumers benefit from the statutory withdrawal rights applicable to distance contracts.

As a general rule, consumers have a 14-day withdrawal period, subject to the legal conditions, exceptions and consequences applicable to the relevant contract.

For digital content not supplied on a tangible medium, early loss of the withdrawal right requires compliance with specific statutory requirements, including where applicable:

  • Prior express consent to begin supply during the withdrawal period.
  • Express acknowledgement of the loss of the withdrawal right.
  • The legally required contractual confirmation.

Specific rules apply to digital services and other contractual arrangements.

Payment, downloading or access alone does not automatically replace any legally required formalities.

Withdrawal and refund requests may be submitted through the channels identified in the purchase confirmation or by contacting paydayea@protonmail.com, according to the contractual seller's identity.

Mandatory statutory rights cannot be excluded by a commercial no-refund policy.

9. Digital Content Conformity and Support

The contractual supplier must comply with the applicable legal requirements governing conformity of digital content and services.

Where digital content or services do not conform to the contract, consumers may be entitled to statutory remedies, including bringing the product into conformity, a price reduction or termination, subject to applicable legal conditions.

Advertised technical support includes assistance with installation and configuration within the applicable commercial terms.

Unless expressly agreed, technical support does not include personalised investment advice, trading account management or compensation for market losses.

10. Financial Risk Disclosure

Trading involves substantial financial risk and may result in the partial or total loss of invested capital.

Automated trading does not eliminate financial risk.

PAYDAY EA may be affected by, among other factors:

  • Market volatility.
  • Slippage and unexpected execution prices.
  • Connectivity failures.
  • Trading platform or broker interruptions.
  • Liquidity changes.
  • Incorrect configurations.
  • Unanticipated market conditions.
  • Losses associated with leverage.

Past performance, simulated results and backtesting do not guarantee future performance.

PAYDAY EA does not guarantee profits, investment returns or protection against losses.

Users should understand the relevant financial instruments and risks before operating the software with real funds.

11. No Personalised Financial Advice

The website provides commercial and informational content about a technology product.

Such content does not, by itself, constitute personalised investment advice, financial consultancy, portfolio management or financial intermediation.

Users remain responsible for their investment decisions and the parameters authorised on their accounts, without prejudice to any legal responsibilities of the supplier.

If any activity actually provided falls within the scope of regulated financial services, the relevant legal requirements must be satisfied before the service is offered.

12. Availability and Software Changes

The operator seeks to maintain the website and related services in a functional and secure condition.

Maintenance, technical incidents or failures of external services may affect availability.

Software updates and changes to digital content or services must comply with applicable contractual terms and legal requirements.

Nothing in these Terms removes statutory consumer rights relating to lack of conformity.

13. Intellectual Property

The PAYDAY EA brand, logos, software, documentation, original graphics and related materials are protected by intellectual property rights held by their respective owners.

Purchasing a licence does not transfer ownership of the source code or other protected assets.

MetaTrader, MetaTrader 5, Whop and other third-party trademarks remain the property of their respective owners.

Reference to external products or platforms does not imply any official partnership, sponsorship or endorsement unless expressly supported by verifiable information.

14. Limitation of Liability

The operator does not guarantee any financial gain or particular trading outcome from use of PAYDAY EA.

Users acknowledge the inherent risks associated with financial markets and trading technology.

Any contractual limitation of liability applies only to the extent permitted by applicable law.

Nothing in these Terms excludes or restricts liability that cannot legally be excluded, including mandatory consumer protections and liability for intentional misconduct or gross negligence where applicable.

15. Third-Party Links

The website may contain links to Whop, technical documentation, trading platforms and other third-party services.

The use of those services is subject to their respective terms and policies.

PAYDAY EA does not exercise complete control over independent third-party services.

16. Personal Data and Cookies

Personal data processing is described in the Privacy Policy.

The use of cookies and similar technologies is described in the Cookie Policy.

17. Complaints and Alternative Dispute Resolution

Customers may submit complaints to paydayea@protonmail.com.

Where applicable, consumers may refer disputes to the competent Portuguese consumer Alternative Dispute Resolution entity.

Portuguese Electronic Complaints Book: https://www.livroreclamacoes.pt, where legally applicable.

These mechanisms do not affect the right to seek remedies before competent courts.

18. Governing Law and Jurisdiction

These Terms are governed by Portuguese law and applicable European Union law.

The choice of Portuguese law does not deprive consumers of mandatory protections that apply under the law of their habitual residence.

Disputes shall be submitted to courts having jurisdiction under applicable law, without prejudice to mandatory consumer jurisdiction rules.

19. Changes to These Terms

These Terms may be amended for legal, technical or commercial reasons.

Amendments do not retroactively remove acquired rights or permit contractual modifications contrary to applicable law.

Customers will be informed of material changes where required by law.
